The state regulates both the sale and consumption of alcoholic beverages through a combination of state statutes and local ordinances, resulting in a patchwork of rules that can vary by county and municipality.

One of the key elements of mississippi alcohol laws  is the division of alcoholic beverages into different categories, primarily beer, wine, and distilled spirits. Beer and wine are generally subject to less restrictive regulations than distilled spirits. The sale of distilled spirits is tightly controlled and can only occur in licensed establishments. Mississippi operates under a control state system for spirits, meaning the state government oversees the distribution and sale of distilled beverages.

Retail sale hours for alcohol are strictly regulated. In most areas, alcohol sales are allowed Monday through Saturday, but Sunday sales are often limited or prohibited, although some counties allow limited Sunday sales after 12:00 PM. Additionally, local dry laws still exist in certain counties, where the sale of alcoholic beverages is entirely prohibited. As of recent years, only a few counties in Mississippi remain fully dry, but local regulations can change, so residents and visitors must check local ordinances before purchasing alcohol.

The legal drinking age in Mississippi is 21, consistent with federal law. Minors caught possessing, consuming, or attempting to purchase alcohol face legal consequences, including fines and potential community service. Furthermore, bars and restaurants are required to check identification rigorously to prevent underage drinking.

Mississippi also enforces strict DUI (driving under the influence) laws. The legal blood alcohol concentration (BAC) limit for drivers over 21 is 0.08%, while drivers under 21 are held to a zero-tolerance standard. DUI penalties can include fines, license suspension, and even jail time, depending on the severity of the offense and whether it is a repeat offense.
